Landscaping Works – Additional Terms

1. Scope of Landscaping Works

Landscaping works are carried out based on the agreed scope, materials, layout, and finish described in the quotation or written agreement.

Any changes to design, materials, layout, levels, or finish requested after work has commenced must be agreed in advance and may result in additional charges or extended timelines.

Verbal changes on site will not be actioned unless confirmed and agreed.

2. Ground Conditions & Unknown Factors

Landscaping work is heavily affected by ground conditions, which may not be fully visible prior to work starting.

Borders Task Busters Ltd cannot be held responsible for delays, changes to method, or additional costs caused by:

  • Hidden obstructions (e.g. concrete, rubble, roots, services)

  • Poor or unstable ground

  • Drainage issues

  • Variations in soil type or depth

Where unforeseen ground conditions arise, work will pause until a revised approach or cost is agreed.

3. Levels, Drainage & Water Management

Unless specifically stated in writing, landscaping works do not include drainage design or ground engineering.

Clients are responsible for confirming:

  • Final ground levels

  • Water run-off expectations

  • Existing drainage performance

Borders Task Busters Ltd is not responsible for water movement, pooling, or drainage behaviour outside the agreed scope.

4. Materials & Natural Variation

Landscaping materials are subject to natural variation in colour, texture, and appearance.

This includes but is not limited to:

  • Stone, paving, aggregates

  • Timber and sleepers

  • Turf, soil, and planting materials

Minor variations do not constitute a defect.

All materials remain the property of Borders Task Busters Ltd until paid for in full.

5. Turf, Seeding & Planting

Living materials are affected by weather, ground conditions, and aftercare.

Borders Task Busters Ltd cannot guarantee:

  • Turf establishment

  • Seed germination

  • Plant survival

Successful establishment depends on:

  • Adequate watering

  • Ongoing maintenance

  • Weather conditions

Once installed, responsibility for care passes to the client unless a maintenance agreement is in place.

6. Setting, Settlement & Movement

Groundworks and landscaping materials may settle or move naturally over time.

This includes:

  • Soil settlement

  • Jointing movement

  • Timber movement

  • Natural ground compaction

Minor settlement or movement is normal and does not constitute a fault.

Remedial works caused by natural settlement are not included unless agreed separately.

7. Access, Storage & Working Area

Clients must provide suitable access for machinery, materials, and waste removal.

Borders Task Busters Ltd is not responsible for:

  • Damage to hidden services

  • Underground utilities not clearly marked

  • Weak or unsuitable access routes

Space may be required on site for material storage during the works.

8. Completion Standards

Landscaping works are considered complete when:

  • The agreed scope has been delivered

  • The area is left safe and usable

  • Waste has been removed or managed as agreed

Landscaping is not a “clean-room” process. Some residual dust, soil, or marks may remain and are considered normal.

9. Aftercare & Maintenance

Unless included in writing, landscaping works do not include aftercare or ongoing maintenance.

Borders Task Busters Ltd is not responsible for deterioration caused by:

  • Lack of maintenance

  • Weather exposure

  • Heavy use

  • Third-party interference

Advice may be given informally but does not constitute a maintenance obligation.

10. Warranty – Landscaping Works

Landscaping works are covered by a workmanship warranty only, confirming that work has been carried out with reasonable care and skill.

This warranty does not cover:

  • Natural movement or settlement

  • Weather-related effects

  • Ground conditions

  • Living materials (plants, turf, seed)

  • Client-supplied materials

  • Changes made after completion

Any concerns must be raised within 28 days of completion to allow inspection.

11. Weather Delays

Landscaping works are weather dependent.

Borders Task Busters Ltd reserves the right to delay, pause, or reschedule work due to weather or ground conditions without penalty.

12. Acceptance

By proceeding with landscaping works, the client confirms acceptance of:

  • These Landscaping Works – Additional Terms
